Terms of Service

1General Provisions

1.1. This Agreement governs the use of hosting, domain registration and other related services provided by “DenizHost.az” (hereinafter, the Provider).

1.2. Any person who registers on the Provider’s official website and/or orders a service (hereinafter, the Customer) confirms that they have read and unconditionally accept all terms of this Agreement.

1.3. The Provider reserves the right to amend this Agreement. Changes take effect from the moment they are published on the official website.

2Provision of Services

2.1. The Provider offers the following services:

• Linux hosting services
• WordPress hosting services
• Domain registration and management
• Email services
• VPS and other additional server services

2.2. The services may be used only for purposes that comply with the laws of the Republic of Azerbaijan.

3Restrictions

3.1. The Customer is prohibited from:

• hosting illegal or copyright-infringing material;
• spam and unsolicited bulk email;
• distributing malware;
• hosting phishing or fake websites;
• attempts to gain unauthorised access to systems;
• excessive resource usage that negatively affects service quality for other users.

4Customer Responsibilities

4.1. The Customer bears full responsibility for all data and activity in their account.

4.2. The Customer is responsible for the security of their username and password.

4.3. The Provider is not liable for damage caused to third parties as a result of the Customer’s activity.

5Provider Responsibilities

5.1. The Provider takes technical measures to keep services running without interruption but is not liable for force majeure events.

5.2. Advanced DDoS protection may be offered as an additional paid service.

5.3. Service uptime and technical guarantees are governed by the separate SLA (Service Level Agreement) document.

6Resource Usage Policy

6.1. To keep servers stable, CPU, RAM, Disk IO and other technical limits may apply.

6.2. Accounts that negatively affect other users may be temporarily restricted or suspended.

7Backups

7.1. The Provider may offer backups as an additional feature.

7.2. The Customer is responsible for keeping a separate backup of their data.

7.3. The Provider is not liable for data loss.

8Payment and Refund Policy

8.1. All services are provided on a prepaid basis.

8.2. A refund may be requested within 14 days from the date the service started.

8.3. When the paid period ends, the service may be suspended automatically.

8.4. The refund policy applies only to Linux Hosting and WordPress Hosting. Payments for VPS and VDS servers are non-refundable.

8.5. If the Customer ordered hosting together with a domain:

• The amount paid for domain registration is non-refundable;
• Only the remaining hosting amount is refunded.

8.6. The Provider reserves the right to change service prices with prior notice.

9Account Suspension and Termination

9.1. The Provider may suspend the service immediately in the following cases:

• Breach of the agreement terms
• illegal activity
• spam or phishing activity
• creating a risk to server security
• late payment

10Domain Services

10.1. The Customer is responsible for the accuracy of the information provided when registering a domain.

10.2. Renewing the domain is the Customer’s responsibility.

10.3. The Provider is not responsible for expired domains.

11Force Majeure

11.1. Natural disasters, war, government decisions, cyberattacks and other unavoidable circumstances are considered beyond the Provider’s control.

12Technical Support

12.1. The Provider offers technical support through the ticket system or official contact channels.

12.2. Technical support covers only matters related to the hosting infrastructure.

12.3. Website programming, code changes and third-party script issues are not included in technical support.

13Data Retention

13.1. After a service expires, the account may be kept for a certain period.

13.2. After that period, the data may be permanently deleted.

13.3. Recovery of deleted data is not guaranteed.

14Disclosure to Law Enforcement

14.1. DenizHost.az may disclose a User’s data to law enforcement authorities upon their lawful request without additional consent from or notice to the User. We cooperate fully with law enforcement.

15Account Security

15.1. The Customer is responsible for protecting account credentials (username, password, tokens, API keys and other login details). The Provider is not liable for any damage resulting from their disclosure to third parties or unauthorised use.

15.2. Using the account for spam, phishing, DDoS attacks, distributing malware or any other illegal activity is prohibited.

15.3. If suspicious or non-compliant activity is detected, the Provider may temporarily block or restrict the account.

15.4. The customer account may be used only for the purposes stated in the Agreement. Transferring, sharing or unauthorised use of the account is prohibited.

15.5. The Customer must observe security measures for the account and follow the Provider’s security recommendations. Any loss or damage resulting from failure to follow security rules is solely the customer’s responsibility.

16Governing Law and Disputes

16.1. This Agreement is governed by the applicable legislation of the Republic of Azerbaijan, and its provisions are fully legally binding. In case of any gaps or ambiguities, the laws of the Republic of Azerbaijan apply.

16.2. All disputes and claims arising from the Agreement or the use of the services shall first be resolved through good-faith negotiations between the parties. If negotiations fail, disputes shall be resolved under the jurisdiction of the courts of Azerbaijan.
